Media Statement: The Enforcement Unit of the MPHS Building Department conducted periodic inspections in the Bukit Beruntung and Bukit Sentosa areas on 11 August 2020

The MPHS Building Department Enforcement Unit conducted periodic inspections in the Bukit Beruntung and Bukit Sentosa areas on 11 August 2020 and as a result of the site inspection found that there were several structures that had been built without MPHS permission. One of the developments that has been subject to enforcement action is SWC Properties Sdn. Bhd. which has been compounded (E 0822) for an offense under Section 70(1), Roads, Drains and Buildings Act (Act 133).
Following that, the owner of the building which is the company SWC Properties Sdn. Bhd. submitted the Planning Permission application and the building plan application simultaneously through the appointed consultant namely Jururancang - JTC Planner Sdn. Bhd. and PSP – Ahmad Zakuan Architect on January 12, 2021.

The Application for Planning Permission and Building Plan was presented in the Local Center Development Planning Committee Meeting (MJKOSCPP) Bill 3/2021 which convened on 19 February 2021 where the application for Planning Permission was approved with conditions. While the Building Plan application was rejected because the applicant had to comply with all technical requirements and the initial work application was also not given consideration. Planning permission was obtained on 7 May 2021.

However, the results of the periodic monitoring that was held on 30 November 2021 found that the owner of the building, which is the company SWC Properties Sdn. Bhd. has resumed construction of building structures on the site without obtaining written permission from the Council. Therefore, the MPHS Building Department Enforcement Unit has taken enforcement action by issuing a warning and compound notice (E4128) for the offense of section 70(1), Roads, Drains and Buildings Act 1974 (Act 133).

The applicant has submitted a second Building Plan application through the Local Center Division (OSC) on 24 November 2021. The applicant has also submitted an application for an Earthwork Plan and Road and Ditch Plan on 20 December 2021.

As for the application for the Land Work Plan and the Road and Drain Plan, it was rejected in the Local Center Development Planning Committee Meeting (MJKOSCPP) No. 1/2022 which convened on January 4, 2022 with the reason that it needs to be consistent with the approved Planning Permission Plan and compliance with the conditions- related Technical Agency conditions.

In addition, the PSP has submitted a letter withdrawing the Building Plan application on 11 January 2022 through the Local Center Unit (OSC) and the Building Department due to the need to comply with the approval of planning permission and other related plans.
The Council takes a serious view of any development carried out without approval to ensure that the development is planned and does not cause problems to the surrounding area. Monitoring and enforcement are always held to ensure that the law is obeyed and at the same time development for the progress of Hulu Selangor is still welcome.
